eavesdropping, battery charges

ELIZABETH-An Elizabeth man is awaiting a court date in Jo Daviess County Circuit Court following charges of battery and eavesdropping.
 According to court records, on Jan. 4, Brian D. Tessendorf, 33, knowing and intentionally caused bodily harm to his ex-girlfriend and mother of his child by striking her in the hip and knee with his fist. The Gazette does not release the name of battery victims. For these acts Tessendorf is facing two counts of domestic battery, a class A misdemeanor that carries a maximum penalty of 1 year in jail and a $2,500 fine for each count.
The day after the incident, Tessendorf allegedly used an eavesdropping device to record at least two different telephone conversations between him and the battery victim without her consent, a class 4 felony in Illinois that carries a maximum penalty of three years in prison and $25,000 for each count.
On Jan. 15, an order of protection was filed against Tessendorf on behalf of the victim.
On Jan. 27, a warrant was issued for Tessendorf's arrest. It was served and executed on the same day. Tessendorf was held and later released on $1,000 bail. A court date has not been set.
Tessendorf, a 1994 graduate of Galena High School, has faced criminal charges in the past. In 2006 he was found guilty of aggravated battery of a volunteer police officer. He was sentenced to a year in prison and two years probation. In 2005, he paid a fine for "disturbing the peace." In 1998, he was sentenced to 30 days in jail and one year's probation for retail theft. In 1997, he was sentenced to one year's probation and paid a fine for knowingly damaging property.
